Our privacy position

Jenercode does not require or permit Personal Data to be included in Customer Projects, Project Specifications, legacy code, MVPs or Project testing. We process only the limited Personal Data needed to operate and administer user accounts and payments, together with website analytics data where a visitor has consented to Google Analytics.

1. Who we are

Jenercode Limited trading as Jenercode ("Jenercode", "we", "us" or "our") provides the Jenercode software generation Platform. For the Personal Data described in this Privacy Notice, Jenercode acts as data controller unless we expressly state otherwise.

2. Personal Data we process

Platform users and account administration

To create, operate and administer Platform accounts, we may process:

• name and username;
• business email address;
• user role and account status;
• authentication and account administration information necessary to provide access to the Platform.

Subscription, billing and payments

Where a Customer subscribes to the Platform or purchases Production Code, we may process:

• billing contact details;
• Subscription and transaction information;
• transaction identifiers and payment status;
• amounts paid or payable and information required for billing, refunds and financial records.

Payment-card and financial-account details must be entered only through the payment interface designated by Jenercode. Where Stripe processes a payment, Jenercode receives only the limited payment and transaction information needed to administer the Customer Account and payment.

Website analytics

If a website visitor consents to analytics cookies, we use Google Analytics 4 (GA4) to understand use of the Jenercode website. GA4 may process session statistics, approximate geographic location, browser and device information and pseudonymous identifiers associated with analytics cookies. Google states that, for users in the EU, Switzerland and the UK, IP addresses are used to derive coarse location and are discarded before being logged or stored by Google Analytics.

Google Analytics is not used to collect information entered into Customer Projects.

Communications

If you contact Jenercode, we will process the contact details and information you choose to provide in that communication for the purpose of responding to you and maintaining an appropriate record of the communication. This includes the details you enter into our contact form — your name, organisation, work email address, the role you select and your message — and the answers you give in our research questionnaire, together with any contact details you provide there for a follow-up conversation.

3. Personal Data is not permitted in Customer Projects

The Platform is not intended to process Personal Data contained in Customer Projects. Customers and Authorised Users must not upload, enter or otherwise provide Personal Data in:

• Project Specifications;
• user instructions or prompts;
• existing or legacy code uploaded to the Platform;
• test data;
• MVPs or MVP testing;
• other Customer Project materials.

Where data is required for development or testing, users must use synthetic or otherwise non-personal data. If Personal Data is submitted contrary to the Jenercode Terms, we may restrict access to, remove or delete the affected material and process it only to the extent reasonably necessary to secure the Platform, investigate the issue and remove the information.

5. Google Analytics and cookies

We use Google Analytics only after the visitor has consented to analytics cookies through our cookie controls. Visitors may reject analytics cookies and may withdraw or change their consent at any time through the cookie settings available on the website.

Jenercode configures its GA4 user-level and event-level data retention period to 2 months. This Analytics retention setting is separate from the lifetime of the analytics cookies stored in a visitor's browser. The cookies used by GA4 and their typical duration are described in our Cookie Notice, which also lists the content this website loads from other services, such as video and fonts.

We do not use Google Analytics to collect Customer Project content, and we do not permit Personal Data to be submitted to Projects for analytics or any other purpose.

6. Who we share Personal Data with

We disclose Personal Data only where reasonably necessary to operate and administer the Services, process payments, use consented website analytics, comply with law or protect Jenercode and its users. Recipients may include:

• Stripe and other authorised payment service providers;
• Google in connection with Google Analytics where analytics consent has been provided;
• technology providers used to host, secure or administer Jenercode's website and Platform;
• professional advisers where reasonably necessary;
• regulators, courts, law-enforcement bodies or other authorities where disclosure is legally required.

We do not sell Personal Data.

7. International transfers

Some service providers used by Jenercode may process Personal Data outside the European Economic Area. Where this occurs, Jenercode will use an appropriate transfer mechanism and safeguards required by applicable data-protection law.

8. How long we retain Personal Data

We retain Personal Data only for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, accounting and regulatory requirements.

• Platform-user and account information is generally retained while the relevant account or Customer relationship remains active and thereafter only as long as reasonably necessary for administration, security, dispute resolution or legal requirements.
• Billing and transaction records are retained for the periods required by applicable accounting, tax and legal requirements.
• Google Analytics user-level and event-level data is configured for a 2-month retention period.
• Communications are retained only for as long as reasonably necessary for the purpose of the communication and any related legal or business record-keeping requirement.

9. Security

Jenercode uses appropriate technical and organisational measures designed to protect Personal Data against unauthorised access, loss, alteration, disclosure or misuse. Access to Personal Data is limited to people and service providers who require it for legitimate operational purposes.

10. Your data-protection rights

Subject to applicable legal conditions and exceptions, individuals may have rights to:

• access their Personal Data;
• have inaccurate Personal Data corrected;
• request deletion or restriction of processing in appropriate circumstances;
• object to certain processing;
• receive certain Personal Data in a portable format;
• withdraw consent at any time where processing is based on consent.

Requests can be sent to legal@jenercode.com. You also have the right to complain to the Irish Data Protection Commission or another competent data-protection authority.

11. Business users

The Jenercode Platform is provided for business use. Personal Data relating to employees, officers, contractors or other Authorised Users of a Customer is processed only as necessary to provide and administer their access to the Services and for the other purposes described in this Privacy Notice.

12. Changes to this Privacy Notice

We may update this Privacy Notice where our Services, technology, legal requirements or data-processing practices change. The current version will be made available through the Jenercode website or Platform and will state its effective date.
